We have now to consider the excitable yet courageous temperament. Running our minds over the peculiarities of our case, we find that the supposition that a man of this type is the criminal, while consistent with the carefulness displayed after the crime, is inconsistent with the weak blow and the crash. If we stretch the case a good deal, we may conceive that the weak blow is given on purpose to mislead, and the crash for some similar purpose; or we can say that the weak blow and the crash were produced by nervousness, for nervousness before such a deed is not inconsistent with a brave temperament. In defence of our last argument we may add, that once the crime is committed and the necessity for escape rendered necessary, the nervousness becomes cautiousness. These two are the only explanations possible, if we take a man of this type to be guilty of the murder.

Temos agora de considerar o temperamento irascível, mas corajoso. Percorrendo as peculiaridades do nosso caso, encontramos que a suposição de um homem desse tipo ser o criminoso, embora consistente com o cuidado demonstrado após o crime, é inconsistente com o golpe fraco e com a batida. Se estendermos bastante o caso, podemos conceber que o golpe fraco é dado de propósito para enganar e a batida para um propósito semelhante; ou podemos dizer que o golpe fraco e a batida foram produzidos por nervosismo, pois o nervosismo antes de um tal feito não é inconsistente com um temperamento bravo. Em defesa do nosso último argumento, podemos acrescentar que, uma vez cometido o crime e face à necessidade da fuga, o nervosismo torna-se cauteloso. Estas são as duas únicas explicações possíveis, se considerarmos que um homem deste tipo é culpado pelo assassinato.
